EzToRoute is committed to protecting its visitors' and EzToTrack's’ privacy. The following Privacy and Cookie Policy outlines the information EzToRoute (hereafter 'EzToRoute', "we", or "us") may process and how we may use that information to better serve visitors and Users while using our website www.eztotrack.com (the 'Website') our mobile applications – Android and iOS (the 'App') and our services (collectively the "Service"). Please review the following carefully so that you understand our privacy practices.

1.  DEFINITIONS

"User" means a person who has signed up and is registered with EzToRoute for the use or potential use of the Service. 

2.  GENERAL

EzToRoute is the processor of your personal data through the Website and the Apps.

CHILDREN UNDER THE AGE OF 13

EzToRoute cares about the safety of children. Because the Service is not directed towards children under 18, they are not allowed to register with or use the Service, or provide personal data. We do not knowingly collect personal information from anyone under the age of 13. If we discover that we have collected personal information from a child under 18, we will delete that information immediately.

LOCATION INFORMATION 

In some cases, we collect and store information about where you are located, such as by converting your IP address into a rough geolocation or through GPS or wireless network triangulation. We may use location information to improve and personalize our Services for you (for example, by helping you complete your driving logs).

 

COMMUNICATIONS AND OFFERS

We may communicate with you via email or through the Services. For example, we may send you promotional email offers on behalf of other businesses, or email you about the use of the Services. Also, we may receive a confirmation when you open an email from us. This confirmation helps us make our communications with you more interesting and improve our services. If you do not want to receive email communications from us, please indicate your preference by emailing contact@eztotrack.com. 

3.  COLLECTION AND USE OF DATA

3.1  HOW DO WE COLLECT AND USE INFORMATION

Our primary goals in collecting information are to provide and improve our Services, to administer your use of the Services (including your Account, if you are an Account holder), and to enable you to enjoy and easily navigate our Services.

1.     Account Information and Information, You Provide Us. 

When you create an Account, we'll collect certain information that can be used to identify you, such as your name, phone number, email address, and office addresses ("Personally Identifiable Information"). We may also collect certain information that is not Personally Identifiable Information because it cannot be used by itself to identify you, such as your DOT number, carrier name and cycle rule. Further, we receive and store any other information that you knowingly provide to us. 

2.     Information Collected Using Cookies. 

We collect certain information through the use of "cookies," which are small text files that are saved by your browser when you access our Services. We may use both session cookies and persistent cookies to identify that you've logged in to the Services and to tell us how and when you interact with our Services. We may also use cookies to monitor aggregate usage and web traffic routing on our Services and to customize and improve our Services. Unlike persistent cookies, session cookies are deleted when you log off from the Services and close your browser. Although most browsers automatically accept cookies, you can change your browser options to stop automatically accepting cookies or to prompt you before accepting cookies. Please note, however, that if you don't accept cookies, you may not be able to access all portions or features of the Services. Some third-party services providers that we engage (including third-party advertisers) may also place their own cookies on your browser. Note that this Privacy Policy covers only our use of cookies and does not include use of cookies by such third parties.

In the event that we send you any offers for services or products provided by our partners or affiliates or you click a link to one of our partners' or business affiliates' or other third parties' websites or services, such partner, affiliated business or other third party may also transmit cookies to your browser or device. This Privacy Policy does not cover the use of cookies by any third parties, partners or business affiliates, and we are not responsible for their privacy policies and practices.

3.     Information Related to Use of the Services. 

Our servers automatically record certain information about how Account holders, and any other End Users, ("Users") use our Services (we refer to this information as "Log Data"). Log Data may include information such as a User's Internet Protocol (IP) address, browser type, operating system, the web page that a User was visiting before accessing our Services, the pages or features of our Services to which a User browsed and the time spent on those pages or features, the links on our Services that a User clicked on, driving logs entered into the Services, documents uploaded to the Services, messages exchanged on the Services and other statistics. We use this information to administer the Services and we analyze (and may engage third parties, such as Google Analytics, to analyze) this information to improve and enhance the Services by expanding their features and functionality and tailoring them to our Users' needs and preferences. We may use a person's IP address to fight spam, malware and identity theft. We also use the IP Address to generate aggregate, non-identifying information about how our Services are used.

3.2  WHAT INFORMATION DO WE SHARE WITH THIRD PARTIES

We will not share any Personally Identifiable Information that we have collected from you except as described below:

1.     Information Shared with Our Service Providers.

We may engage third party service providers to work with us to administer and provide the Services. These third-party service providers have access to your Personally Identifiable Information only for the purpose of performing services on our behalf and are expressly obligated not to disclose or use your Personally Identifiable Information for any other purpose. For example, we may use a payment processing company to receive and process your credit card transactions for us. Unless we tell you differently, our service providers do not have any right to use the Personally Identifiable Information or any of Your Data that we share with them beyond what is necessary to assist us.

2.     Information Shared with Third Parties. 

We may share aggregated information and non-identifying or de-identified information with third parties for industry analysis, demographic profiling and other similar purposes. We share your driving logs and documents only with your consent (e.g., with those users you connect with on the Services or share Your Data with via email or Bluetooth from the Services).

3.     Information Shared with Affiliated Businesses and Partners. 

In certain situations, businesses or third party websites with whom we've partnered or affiliated with may sell or provide products or services to you through or in connection with the Services (either alone or jointly with us) or we may provide the Services in connection with such partner or affiliated business' other products and services. In the event that you are receiving products or services from one of our partners or affiliated businesses, we may share Your Data and/or your Personally Identifiable Information for such services to be provided. For example, we may partner with a business who needs access to your driving data and your Personally Identifiable Information in order to provide you with certain fueling or insurance services, or we may partner with a reseller of our products and services from whom you are receiving other products and services.  

We have no control over the policies and practices of third party websites or businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to a partner or affiliated website or business, please review all such business' or websites' policies and any agreements between you and such affiliated website, partner or business.

If you authorize us to, consent to us to, or otherwise select or use a third-party service for which we deem it necessary to share your Personally Identifiable Information or Your Data with a third-party, affiliated business or partner through the Website or the Services, we may share your Personally Identifiable Information or Your Data.  

Further, if you authorize or consent to a third party's receipt Your Data or your Personally Identifiable Information, we may rely on a representation from that third party that you have authorized such third party to receive Your Data or your Personally Identifiable Information. 

4.     User Profiles and Submissions. 

Your user profile information contains your name, location, email address and phone number associated with your Account and profile ("User Profile Information"). This User Profile Information may be displayed to other users, such as Fleet Users, with whom you connect. Your name and User Profile Information may also be displayed to others when you send messages through the Services. We do not control the policies and practices of any of our users, Fleet Users or any other third party sites or services.

5.     Information Disclosed in Connection with Business Transactions. 

Information that we collect from our users, including Personally Identifiable Information, is considered to be a business asset. As a result, if we go out of business or enter bankruptcy or if we are acquired as a result of a transaction such as a merger, acquisition or asset sale, your Personally Identifiable Information and Your Data may be disclosed or transferred to the third-party acquirer in connection with the transaction. 

6.     Information Disclosed for Our Protection and the Protection of Others. 

It is our policy to protect you from having your privacy violated through abuse of the legal systems, whether by individuals, entities or government, and to contest claims that we believe to be invalid under applicable law. However, it is also our policy to cooperate with government and law enforcement officials and private parties. Accordingly, we reserve the right to disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary: (i) to satisfy or comply with any applicable law, regulation or legal process or to respond to lawful requests, including subpoenas, warrants or court orders; (ii) to protect our property, rights and safety and the rights, property and safety of third parties or the public in general; and (iv) to prevent or stop activity we consider to be illegal or unethical.

4.  OUR DISCLOSURE OF YOUR INFORMATION

We may employ third party companies and individuals to facilitate or provide the Service on our behalf, to process payment, provide customer support, provide geo-location information to our Drivers, to host our job application form, to perform Website-related services (e.g., without limitation, maintenance services, database management, web analytics and improvement of the Website's features) or to assist us in analyzing how our Service is used. These third parties have access to your personal information only to perform these tasks on our behalf and are contractually bound not to disclose or use it for any other purpose.

EzToRoute will disclose your personal data to the extent that this is legally required, or necessary for the establishment, exercise or defense of legal claims and legal process; or in the event of an emergency pertaining to your health and/or safety.

 

5.  Links to Other Sites

Our Services may contain links to other websites and services. Any information that you provide on or to a third-party website or service is provided directly to the owner of the website or service and is subject to that party's privacy policy. Our Privacy Policy does not apply to such websites or services and we're not responsible for the content, privacy or security practices and policies of those websites or services. To protect your information, we recommend that you carefully review the privacy policies of other websites and services that you access.

6.  YOUR RIGHTS

As a user, you have the right to information regarding your personal account. You may at any time request correction or erasure of your personal data, and object to any processing of your personal data by emailing us at contact@eztotrack.com. We will respond to your access and/or correction request within four weeks. You may also amend your personal details and withdraw any given consent using your EzToRoute account.

7.  RETENTION

Unless specified otherwise in this Privacy and Cookie Policy, we will retain your information until you cancel your EzToRoute account, or until your EzToRoute account has been inactive for a year. If you wish to cancel your EzToRoute account or request that we no longer use your information to provide you services, please contact us at contact@eztotrack.com. Upon expiry of the one year period of inactivity, we will alert you and give you two weeks to re-activate your EzToRoute account or retrieve any personal information you want to keep. After deletion of your account we will anonymize your data, unless these data are necessary to comply with a legal obligation or resolve disputes.

8.  SECURITY

EzToRoute has taken appropriate technical and organizational security measures against loss or unlawful processing of your personal data. To this purpose, your personal data are securely stored within our database, and we use standard, industry-wide, commercially reasonable security practices such as encryption, firewalls and SSL (Secure Socket Layers) as well as physical safeguards of the locations where data are stored.

However, as effective as encryption technology is, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that information you supply won't be intercepted while being transmitted to us over the Internet. Any transmission of information by you to EzToRoute is at your own risk. We recommend that you do not disclose your password to anyone.

9.  COOKIE POLICY

The Website uses "cookies". A cookie is a small text file that we place on your computer or mobile device to enable various features of the Website. You can change your cookie settings to accept or not accept cookies in your browser settings.

THE WEBSITE USES THE FOLLOWING COOKIE CATEGORIES:

Essential: EzToRoute uses cookies necessary to enable or enhance certain functionality of the Website, such as recalling your recent actions on the Website or remembering your Website settings. If you have cookies disabled in your browser, these cookies will be blocked. Non-essential: EzToRoute uses Google Analytics' cookies. If you have cookies disabled in your browser, these cookies will be blocked. Google Analytics is a web analysis service that is offered by Google Inc. Google Analytics uses cookies to analyze the usage of the Website by Users to give EzToRoute an insight in the way Users use the Website.

10.  CHANGES IN THIS PRIVACY POLICY

We may update this privacy statement to reflect changes to our information practices. If we make any material changes we will revise this Privacy Policy to reflect such changes and revise the effective date included at the top of this policy. We encourage you to periodically review this page for the latest information on our privacy practices. Please note that if you've opted not to receive legal notice emails from us (or you haven't provided us with your email address), those legal notices will still govern your use of the Services and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes.
